TL;DR

What to know before you sign up

  • You're a business owner. The service runs as a public offer — by signing up you accept these terms.
  • We don't make sales calls and don't take a percentage of your revenue. Pricing is fixed, listed in section 4.
  • We don't sell your data and use it only to run the service (see the Privacy Policy).
  • Refunds for unused services are possible within 5 days after a service outage (section 5).

This Terms of Service agreement (the «Agreement») governs the relationship between OPSoft Inc, a Wyoming corporation registered at 30 N Gould St, Ste R, Sheridan, WY 82801, United States — hereinafter the «Company» — and any person or entity («User») accessing or using the website at sbs.im, its subdomains, the associated mobile applications, and the Telegram bot (together, the «Service»).

Acceptance of terms

This Agreement is a public offer and becomes binding the moment the User creates an account on the Site, registers through the Service's Telegram bot, or otherwise begins using the Service. Continuing to use the Service after changes to these terms have been published constitutes acceptance of the revised terms.

The User represents that they have the legal capacity and authority to enter into this Agreement.

The service

SBS is a loyalty-program and customer-engagement platform, including: cashback / cumulative-discount programs, digital gift certificates, QR cards compatible with Apple Wallet and Google Wallet, email campaigns and wallet push notifications, reservation and appointment booking, a branded customer-facing Telegram bot, and a business landing page with embedded sign-up form.

The Company provides the Service «as is» and may modify its features, add new ones or retire legacy ones at any time, with reasonable notice for paid features.

Your account

  • You are responsible for keeping your login credentials confidential and for all activity performed through your account.
  • You must provide accurate information when creating the account and keep it up to date.
  • You must not copy, resell or commercially redistribute any part of the Service without the Company's written permission.
  • You may stop using the Service and request deletion of your account at any time — see the Account deletion page.
  • The Company may suspend or close your account in case of a material breach of these terms.

Pricing of services

The «Solo» plan is free forever for solo owners without staff. Paid plans are billed at a fixed monthly rate:

  • «Professional» — $8.90 per month; up to 3 staff accounts per shop.
  • «Business» — $19.90 per month; unlimited staff and locations, priority support, custom development.

Fees are charged in advance to the balance of the User's account on the Service. Payment is processed via international payment systems. SMS delivery, where used, is billed per message at operator rates (typically from $0.30 per SMS depending on country).

Refunds for unused services

The User may request a refund for paid services if the Service was unavailable for more than five (5) consecutive days due to the Company's fault. In case of a material breach of these terms by the User, the Company reserves the right to deny the refund. If the User deletes their account (for example via the bot command /stop), any remaining account balance is not refunded.

Refund requests must be made in writing to support@sbs.im. Refunds are returned to the original payment method within a reasonable time after approval.

Limitation of liability

The Service is provided on an «as available» basis. To the maximum extent permitted by law, the Company is not liable for any indirect, incidental or consequential damages arising from use or inability to use the Service, from unauthorized access to the User's communications, or from the conduct of any third party on the Site.

The Company is not responsible for the execution of loyalty programs run by individual merchants using the Service; disputes between merchants and their end-customers are resolved between those parties.

Changes to the terms

The Company may amend these terms from time to time by publishing a new version on the Site. Continued use of the Service after publication constitutes acceptance. Users are encouraged to check this page periodically.

Governing law

This Agreement is governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws provisions. Any dispute shall be resolved in the competent courts of the State of Wyoming.
